Terms of use
Effective September 26, 2026 · updated October 27, 2026
These terms govern the use of Vota —the website, the mobile and desktop apps and the
Microsoft Teams app— provided by Birdie Limitada, Santiago, Chile ("Birdie", "we"). By
creating an account or using Vota you accept them. How we handle personal data is described
in the privacy policy, which is part of these terms.
What Vota is
Vota is a tool for organizations whose members are named to run polls and votes: they
build the roll, call a vote, and their members vote from any device. Vota counts the votes
and keeps the record. Vota does not certify the legal validity of a decision:
whether a vote meets the bylaws, the quorum or the law that governs the organization is up to
the organization that calls it.
Your account
- You sign in with Google, Apple, Microsoft or an email and password. You are responsible
for keeping your credentials safe; we recommend turning on the second factor.
- The information you provide must be true. An account belongs to one person and can't be
shared: a shared account would let one person vote for another.
- You can delete your account at any time from the app or at
vota.birdie.cl/cuenta, with the effects described in the privacy
policy.
Organizations and their administrators
Whoever creates an organization and whoever administers it are responsible for its roll:
inviting only people who belong to it, keeping the weight of each vote in line with its rules,
and calling each vote properly. The organization decides who may see results and the roll
within the options Vota offers.
Acceptable use
You may not use Vota to:
- impersonate another person or vote in someone else's place without a valid proxy;
- try to find out how someone voted in a secret poll, or to link a ballot to a person;
- send invitations to people who didn't ask for them, or use Vota to send spam;
- interfere with the service, get around its limits or access data that isn't yours;
- break the law or third-party rights.
We may suspend accounts or organizations that break these rules, and we'll tell you why
unless the law prevents it.
Plans and payments
Vota can be used for free, for up to 500 people per organization. Voting by unit, weighted
voting and condo-law sessions need a paid plan —Essential, Community or Corporate—, and its price
and what it includes are shown before you buy. The plan belongs to the organization, not to a
person: its owner buys it and it covers all its members.
- Options. A monthly or yearly subscription, which renews automatically at
the end of each period for the same term and at the current price unless you cancel it; or a
30-day meeting pass, which does not renew.
- Where you pay. On the website, in Teams and in the Windows app, payment is
processed by Polar (polar.sh), which acts as the seller to you and issues the receipt with its
taxes. In the iPhone and iPad app it is charged by Apple to your Apple Account, and in the
Android app by Google Play. An organization can also sign a direct agreement with Birdie,
invoiced.
- Cancelling. You can turn off renewal at any time, and the plan stays
active until the end of the period already paid. You cancel where you paid: in Polar's portal,
reached from the plan screen; in your Apple Account settings, at least 24 hours before the end
of the period; or in Google Play's Subscriptions.
- When a plan ends the organization goes back to the free plan. Its polls,
results and minutes are kept; what changes is what can be published from then on.
- Prices. If a price changes, the new one applies only from the next
renewal, and you are told beforehand.
- Refunds. They follow the policy of whoever charged you —Polar, Apple or
Google—, without prejudice to your rights under consumer law. If something didn't work as it
should, write to us.
- App Store purchases are also governed by
Apple's standard licensed application end user license agreement (EULA), and
Google Play purchases by the Google Play terms of service.
Buying a plan doesn't change what you can see of other people's votes.
Availability
We work to keep Vota available and secure, but we don't guarantee uninterrupted service:
there may be maintenance, provider failures or outages beyond our control. If a vote is under
way, we recommend setting a closing time with some margin.
Liability
To the extent permitted by law, Birdie is not liable for indirect damages or for decisions
an organization adopts using Vota. Nothing in these terms limits the rights that consumer
protection law grants you.
Changes
If these terms change in a relevant way, we'll let you know inside the app before the new
version takes effect. If you don't agree, you can delete your account.
Governing law
These terms are governed by the laws of Chile. Any dispute will be submitted to the courts
of Santiago, without prejudice to the rights consumer law grants you.
